DOES AGULNICK HANDLE VEHICLE DAMAGE CASES?
Currently Agulnick Kremin is not accepting cases involving only damage to motor vehicles, and without personal injury.  We do handle however representation of individuals appearing for Examination Under Oath in connection with a vehicle claim.  

IS THERE A FEE FOR REVIEW OF A DENIED CLAIM?
No.  Agulnick Kremin offers a no fee preliminary review of your insurance claim denial.  To have an attorney review your claim and discuss it with you, you may email a brief description of your claim and a copy of the denial to simone@agulnickkremin.com.  Faxes are received at (718)732-2110.  An attorney will contact you shortly thereafter to schedule a convenient time for a telephone consultation. 

CAN I RECOVER FOR MY LOSS IF I DON'T HAVE INSURANCE?
In many cases, even if you do not have insurance, or don't have enough insurance, you may be able to recover for your loss.  If you are able to establish negligence on the part of another, you may be able to recover, or if there is another contractual ground for another's liability.  It is essential that you discuss your loss with an attorney as soon as possible to determine your rights.

WHAT KIND OF FEE ARRANGEMENTS ARE AVAILABLE?
Fee arrangements are dependent upon the particular type of matters.  In many cases against insurance companies or for damages by third parties, contingency fee arrangements are available. Some matters are handled on an hourly basis. Regardless of the type of matter, our office will discuss your options and provide you with the information you need to make the right decisions.

Agulnick Kremin can provide a no charge claim evaluation.  Whether you have had a claim denied, or have no insurance, we can discuss your options.  Even if your claim has been declined by another lawyer, we may be able to offer a different approach or strategy.  It is important that you call us without delay.  Time to file suit is limited.

HOW LONG DO I HAVE TO FILE A LAWSUIT?
For fire policies in New York, the New York Insurance law provides for 24 months to file a lawsuit against an insurance carrier.  Those who are familiar with the statute of limitations for breach of contract may be unaware of the shortened limitations period for insurance lawsuits.  There are some policies with time to file suit as little as one year.  For negligence claims against others the law allows for 3 years to file a lawsuit.  Do not delay however. Prompt action works to your benefit in a multitude of ways.  

HOW DOES AGULNICK KREMIN OVERTURN DENIALS?
Every claim is different. However, the short answer is insurance policies are contracts.  Some denials are fact based, where the facts and circumstances surrounding the claim are in dispute.  We hold insurance companies to their burden of proof and counteract their attempts to use the facts against the policyholder.  In claims where policy interpretation is dispositive, we employ strategies such as contra preferentem, argue ambiguities, policy reconciliation, and policy analysis.

HOW LONG HAS AGULNICK KREMIN BEEN HELPING CLIENTS?
The seed for Agulnick Kremin was planted in 2005 when Scott Agulnick opened his insurance litigation firm.  Since that time, its attorneys have helped countless home and business owners recover after their insurance and property damage claims were denied, underpaid, and problematic.  Todd Kremin joined Agulnick after 15 years of large firm insurance coverage experience to form Agulnick Kremin in 2021.

WHAT COURTS DOES GAK PRACTICE IN?
AK's attorneys are admitted in New York State Court, Federal District Courts, Second Circuit, and in Connecticut.  AK works with a network of colleagues nationwide for matters outside New York and Connecticut.  

WHAT IF I AM UNABLE TO GET TO AK'S OFFICE?
If you are unable to come to us, that's not a worry.  Either we will come to you, meet virtually, or make other arrangements.  Our office is where we hang our coats, but our practice is state-wide.  

IS MY CLAIM TOO SMALL?
Generally, GAK does not handle matters which would qualify for small claims court, meaning the amount in dispute is less than $7,500 or $5,000.  Although we would love to help, small claims courts are designed for non-attorneys.  All other matters are reviewed on a case by case basis.

WHAT IF I NEED A PUBLIC ADJUSTER?
Sometimes you don't need an attorney, or just not yet.  We work with a network of highly qualified and trained public adjusters to assist you. AK can connect you with such a public adjuster to assist you with your claim.  Throughout the process, we will be available to answer any questions or address concerns you may have.  GAK does not charge for this service, and there is no additional cost to the policyholder, although AK may receive fees from the adjuster for participating in the process.
